Terms of Service

1. Acceptance of Terms

By accessing or using PicGallery, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions, you may not access the platform or use any of our services.

2. User Roles & Responsibilities

PicGallery serves two primary user types:

• Studios (Photographers/Agencies): You are responsible for the content you upload, managing client access via passwords or direct links, and maintaining the subscription for your storage limits.
• Clients: You are granted access to specific galleries by Studios to view, download, or provide feedback on photos. You agree not to distribute or commercialize these photos without explicit permission from the Studio that owns them.

3. Intellectual Property Rights

PicGallery does not claim ownership of the photographs, logos, or client data you upload. Studios retain 100% of their copyright and intellectual property rights to their images. By uploading content, you grant PicGallery a limited license strictly to host, display, and facilitate the sharing of your galleries as part of the service provided to your clients.

4. Acceptable Use Policy

You agree not to use PicGallery to:

• Upload, store, or share any content that is illegal, abusive, harassing, or violates the rights of others.
• Attempt to bypass security protocols or access galleries you have not been explicitly invited to.
• Use the platform for mass file-sharing unrelated to professional photography client proofing.

We reserve the right to terminate accounts that violate this policy without prior notice.

5. Payments and Subscriptions

Studio accounts require a paid subscription (billed in INR) based on storage and gallery limits. Subscriptions are billed on a recurring basis. You may cancel your subscription at any time; however, there are no refunds for partially used billing periods. Upon cancellation, your data will be retained for 30 days before permanent deletion.

6. Limitation of Liability

PicGallery provides the platform "as is." While we utilize secure cloud infrastructure, we are not liable for any loss of data, missed client deadlines, or loss of revenue resulting from platform downtime or file corruption. Studios are encouraged to maintain local backups of all uploaded files.
